INTERDISTRICTS & EXPULSION PROCESS

Student Services has been designated by the Imperial County Board of Education to process and prepare appeals regarding interdistrict attendance petitions and expulsions. All appeals must be filed within thirty (30) calendar days from the date of the school district’s written final decision on a case. Forms mailed and postmarked but not actually received by the Student Services office during the normal business hours of 8:00 a.m. to 5:00 p.m. and within the 30 calendar days will not be accepted.

Final decisions on all matters that cannot be informally resolved through the Student Services office can only be rendered by the County Board. The Imperial County Board of Education is committed to an objective review of and consideration of appeals for students denied interdistrict attendance petitions  and expulsions from local school districts.  The laws on student attendance, interdistrict attendance agreements, and interdistrict attendance appeals are found in California Education Code Sections 46600-46611, 48200-48204, as well as the local School district's policies and administrative regulations for inter-district attendance, apply to these appeals.

Interdistrict Attendance Appeal Process

California Education Code 48200 provides that a pupil shall attend school in the district in which the parent or legal guardian resides, unless otherwise exempted. A parent whose request for his/her child to attend school outside of the district of residence has been denied may appeal to the County Board of Education. An appeal may be submitted whether the permit request was denied by the district of residence or by the district of desired attendance. Districts begin accepting requests for interdistrict petitions, for each school year between February 1st through April 15th of each school year. For specific information and deadlines please contact your district of residence.

Expulsion Appeal Process

An expulsion is an action to remove a child from school and to limit the kinds of schools the child may attend. The County Board of Education has designated the Student Services to process Expulsion Appeals. An appeal must be filed within 30 calendar days. The information on this page will guide you through the appeal process and identify the persons to whom you may direct your questions.
