Overview
Attached you will find a copy of the recently effective (January 1, 2007) Senate Bill 1327 (Soto) and Education Code 48203 as well as a reporting form that is to be used to report the required new information.
This legislation requires a new reporting process for both public and private schools for students who are qualified Section 504 of the Rehabilitation Act of 1973 or Special Education Student Individuals with Disabilities Education Act (IDEA) who are subject to compulsory education laws of California. This bill amends Education Code 48203 which required school districts and private schools to report to the county superintendent of schools upon the severance of attendance or denial of admission of any child who is physically handicapped, mentally retarded or multiple handicapped, but is otherwise subject to compulsory education, to report the severance, expulsion, exclusion, exemption, transfer or suspension beyond 10 school days.
This bill now expands students who must be reported to the county superintendent of schools any individual with exceptional needs (as defined in Section 56026) or Section 504 of the rehabilitation Act of 1973 (29 U.S.C. Section 793) but who is otherwise subject to the compulsory education laws of education. This law requires districts to provide names, ages, and last known addresses of each student. We have confirmation with California Department of Education that this would not break federal confidentiality laws because the Imperial County Office of Education is an educational entity that is required by state law to collect the information and examine these reports.
Please submit reports by the 10th day of each month for the previous month, every month beginning January 2007.
